What is a cover in 2025 (and what is NOT a cover)
A cover is a new faithful interpretation of an existing song:
- same lyrics
- same melody
- free arrangement but without altering the structure of the work
The moment the melody is modified, the lyrics are changed, or the song is inserted into a mashup / remix / manipulated electronic version, it is no longer a cover it is a derivative work.
And derivative works require direct authorization from the original publisher.
In 2025, many artists are receiving rejections from distributors precisely because they uploaded “cover” which in reality are not.
Licenses required to publish a cover in 2025
The cover always requires, in every territory, a mechanical license. But how it is obtained varies between Europe, the USA and the rest of the world.
Licenses in the United States (updated 2025)
Starting in 2021, with the MLC (Mechanical Licensing Collective) fully operational, artists can release digital covers in the US without having to apply for a license.
Here's how it works:
- No need to ask for permission. The license is required by law (compulsory license).
- However, you must pay mechanical royalties. The MLC collects and distributes these royalties to publishers.
- What should the artist do? Make sure that: a.the metadata is correct (title, composer, lyricist, ISWC) b.the wording “Cover Version” is indicated when requested c.the distributor correctly pays the mechanical fees to the MLC
Important 2025 Note:
The MLC holds millions of dollars in unclaimed royalties. If your song data is incorrect, your royalties could end up in “unclaimed”. I can help you verify. If the song is distributed in physical format or direct download (outside the MMA), a traditional mechanical license through HFA or Music Reports is still required.
Licensing in Europe in 2025
In Europe, mechanical licensing is handled by national collecting societies such as:
- SIAE (Italy)
- MCPS (UK and international)
- GEMA (Germany)
- SACEM (France)
- SGAE (Spain)
Digital distribution is automatically authorized but:
- The publisher must be paid correctly.
- The collecting society must be able to identify the song.
- You must respect the original version (melody, lyrics).
